THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.41123 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

Refusal endorsement by the Registering Authority, the Sub-Registrar, Allavaram, Amalapuram, East Godavari District, the 3rd respondent, is questioned in this Writ Petition, as the document presented by the petitioner was refused on the ground that survey numbers do not tally with Online Web Land. The petitioner states that for the default of the revenue authorities in correcting the entries, the petitioner cannot suffer and refusal endorsement is not sustainable. However, the remedy for the petitioner is not before this Court by the present Writ Petition but to approach the Tahsildar, Totlavalluru Mandal, Krishna District, the 4th respondent, and seek appropriate correction to enter his land into the Web land.

The petitioner has also a remedy of questioning the refusal endorsement before the appellate authority, namely, the District Registrar, East Godavari District at Rajahmundry, the 2nd respondent, and in the meanwhile, it is open for the petitioner to approach the 4th respondent and get the Web land rectified so far as the land in question is concerned and on such rectification, if the appeal is preferred by the petitioner, the appellate authority shall take note of the circumstances and pass appropriate orders expeditiously. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
