HONOURABLE JUSTICE G. SRI DEVI TRANSFER CRIMINAL PETITION No.80 of 2019 ORDER:

The present Transfer Criminal Petition is filed by the petitioner/de facto complainant, seeking transfer of C.C.No.162 of 2017 (old C.C.No.1100 of 2011) from the file of the XXII-Additional Chief Metropolitan Magistrate, Secunderabad to any other Chief Metropolitan Magistrate Courts at Hyderabad or Secunderabad. On 07.02.2020, this Court, after hearing the learned Counsel for the petitioner/de facto complainant, learned Additional Public Prosecutor for the 1st respondent-State and learned Counsel for the accused, reserved the matter for orders.

After reserving the matter, on 17.02.2020, learned Counsel for the petitioner/de facto complainant filed a Memo seeking permission to withdraw the above Transfer Criminal Petition, stating that the learned Magistrate has proceeded with the case in C.C.No.162 of 2017 without granting any adjournments and now the case is posted for further evidence of P.W.9.

In view of the Memo filed by the learned Counsel for the petitioner/de facto complainant and since the learned Magistrate has already recorded the evidence of P.Ws.1 to 8 and posted the matter for further chief examination of P.W.9, permission as sought for is accorded.

Accordingly, the Transfer Criminal Petition is dismissed as withdrawn.
