THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20124 of 2015 ORDER:

Petitioner states that she is a resident of Gonabavi Village, Gummagatta Mandal, Anantapur District and she was appointed as a permanent fair price shop dealer of Gonabavi Village on 20.05.2008. While so, suspension order was issued on 12.06.2015 on the allegation that she was residing with her husband in Bangalore city of Karnataka State and the shop is being run by her father-in-law, who is not properly distributing the essential commodities to the cardholders and causing much inconvenience to them. Challenging the said suspension order, the present writ petition is filed.

This Court considered the allegation levelled against the petitioner and noticed that though she was appointed as a permanent fair price shop dealer way back in the year 2008, when herself and her husband were residing in their village, the present allegation relates to their shifting to Bangalore city and running of the shop by her father-in-law. In the circumstances of the case, this Court finds a prima faice case in the allegation levelled against the petitioner. Hence, this Court is not inclined to interfere with the order of suspension.

Accordingly, the Writ Petition is disposed of directing the 4th respondent to complete the enquiry within a period of 30 days from the date of receipt of a copy of this order. No costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
