THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL CRI MI NAL PETI TI ON No.9531 of 2016 ORDER:

This criminal petition is filed against the order of issuance of nonbailable warrant against the petitioner/A2 in PRC.No.6/2016 on the file of the VI Additional Judicial First Class Magistrate, Warangal, vide docket order dated 13.06.2016.

Heard both sides.

It is alleged that the concerned police have filed charge sheet in Cr.No.15/2013 of Subedari P.S, Warangal District against the petitioner/A2 and the non-petitioner/A1 for the offences punishable under sections 447 and 506 IPC and under Section 3(1)(v) of SCs & STs (POA) Act, 1989, showing the petitioner/A2 as absconding. The charge sheet shows that the non-petitioner/A1 has obtained anticipatory bail, surrendered before the Court below and released on bail.

Having regard to the facts and circumstances of the case, the petitioner/A2 is directed to surrender before the Court below and file appropriate application to recall the warrant within 15 days from today and on filing such application, the Court below shall allow it on terms which are just and reasonable.

The Criminal Petition is accordingly disposed of. Pending miscellaneous applications, if any, shall stand closed in consequence.
