THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21417 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue an appropriate order or direction more particularly a writ of MANDAMUS declaring the action of the 3rd respondent in not completing the audit of the accounts with regard to the building of Telangana class IV employees central association bhavan and the rents received from the mulgies, situated at NTR chowk, Adilabad inspite of the directions of the 2nd respondent vide proceedings no. F1/421H2015, date 13.02.

2016 as illegal, arbitrary, unjust, contrary to law and consequently direct the 3rd respondent to complete the audit of the accounts with regard to the building of Telangana class IV employees central association bhavan and the rents received from the mulgies immediately and submit the report for taking further action by the 2nd respondent and further direct the 4th respondent to collect the monthly rents from the tenants of the petitioner union building and deposit the same in the account of the government till the dispute of the building is resolved in the interest of justice and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioner and also the learned Government Pleader for Cooperation, representing the respondents 2 to 4, before ordering notice to unofficial 5th respondent and perused the prayer in the writ petition with supporting affidavit and also the letter of the District Collector, Adilabad - 2nd respondent, addressed to the District Cooperative Officer - 3rd respondent herein, dated 13.02.2016, to conduct audit of the accounts of the Class IV Employees Union, Adilabad and to submit a detailed report. 3.

The prayer of the petitioner in the present writ petition is to direct the 3rd respondent for early completion of the audit report, pursuant to the direction of the 2nd respondent and submit the same to the 2nd respondent.

Having regard to the above, this writ petition itself is disposed of, directing the 3rd respondent to complete the said task, pursuant to the proceedings of the 2nd respondent referred supra, dated 13.02.2016, vide No.E1/4210/2015, within eight weeks from the date of receipt of copy of this order.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
