HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 33128 OF 2012 ORDER :

When the matter is taken up for hearing, Sri G.Seena Kumar, the learned Standing Counsel for APEWIDC submits that the petitioner is challenging the action of the respondents in not treating the suspension period as 'on duty' and this Hon'ble Court was pleased to grant interim directions directing the respondents to pass final orders in the disciplinary proceedings within eight weeks, vide orders dated 7-10-2015. The learned Standing Counsel for APEWIDC further submits that final orders were passed in the disciplinary proceedings initiated against the petitioner and the petitioner was dismissed from service, vide proceedings dated 11-7-2015 and challenging the orders of dismissal WP No.23915 of 2016 was filed. In view of the subsequent development, after filing of the writ petition, the cause in the writ petition does not survive and contends that the writ petition has become infructuous.

This Court, having considered the said submission, is of the considered view that the cause in the writ petition does not survive. Until and unless the dismissal orders are set aside by this Hon'ble Court, the relief sought for by the petitioner cannot be granted in this writ petition. In view of the same, the writ petition is dismissed.
