The petitioners pray for the following relief: "...Writ of Mandamus, declaring the action of the respondents in interfering with the peaceful possession and enjoyment of the petitioners' land to an extent of Ac. 0. 50 cents in Sy. No. 39/7 (Ac. 0.30cetns), Sy. No. 39/9 (Ac 0.20cetns) of Akkarampally village, Tirupati Urban Mandal, Chittoor District by erected a board, without notice and without following due process of law as illegal, arbitrary and contrary to the procedure contemplated under Revenue laws and also in violation of constitutional rights guaranteed under Articles 14 and 300 (A ) of the Constitution of India and consequently direct the respondents not to dispossess the petitioner from the aforesaid lands..."
This Court granted status quo on 02.05.2018 and modified the status quo order on 14.06.2018. The respondents filed I.A. No.2 of 2018 seeking vacation of the interim order granted by this Court. The stand of respondents delineates between Survey No.39/ 7 measuring Ac.0-30 cents and Ac.1-00 in Survey No.39/ 9 of Akkarampally Village. Having regard to the reply given in the counter affidavit, there is no cause of action for considering any relief to the extent of Ac.0-30 cents in Survey No.39/ 7 of Akkarampally Village. As regards the other extent is concerned, the 4th respondent refers to a few proceedings whereunder the patta granted to petitioner has been cancelled.
Mr.A.P.Reddy seeks liberty to challenge the proceedings issued by respondent No.4 before the competent authority and
having regard to the stand taken in the counter affidavit, does not press the writ prayer. By granting the liberty as prayed for, the writ petition is dismissed. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT, J Date:04.07.2018 Stp
