HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO CIVIL REVISION PETITION No. 1754 OF 2016 ORDER:

This Civil Revision Petition is filed against the order dated 06.01.2016 passed in I.A.No.1786 of 2015 in O.S.No.86 of 2008 on the file of the learned Principal Junior Civil Judge, Chirala, Prakasam District.

The petitioner herein is the plaintiff in the aforesaid suit. The petitioner earlier filed an application for appointment of an Advocate Commissioner and the said application was allowed.

The Advocate Commissioner so appointed submitted his report. Now the present application is filed seeking to entrust the matter to same Advocate Commissioner for submitting fresh report after revisiting the suit schedule property. The said application was dismissed by impugned order dated 06.01.2016. Challenging the same, the present Civil Revision Petition is filed.

On instructions, learned Counsel for the petitioner submits that the petitioner would proceed with the case based on the report already submitted by the Advocate Commissioner and hence he does not want to press the present Civil Revision Petition.

In view of the aforesaid submission of the learned Counsel for the petitioner, the Civil Revision Petition is dismissed. However it is needless to observe that if any objections are filed to the report of the Advocate Commissioner, the trial Court shall consider the same in accordance with law. Miscellaneous petitions pending consideration if any in the Civil Revision Petition shall stand closed in consequence. No order as to costs.
