HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39673 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 4th respondent in considering the representations dated 01.01.2016 and 09.06.2016 made by the petitioner to incorporate his name in revenue records, as illegal and arbitrary. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

As seen from the averments made in the affidavit filed in support of the writ petition, the petitioner is said to have made a representation to the Tahasildar seeking issuance of pattadar passbook and title deed in his favour, in respect of the land which he is cultivating, while admitting the same to be a government land. The inaction of the respondents in considering his representation led to filing of the present writ petition. The question of granting pattadar passbook/title deed basing on a representation would not arise. A procedure has been prescribed under the Act for issuance of pattadar passbook/title deed and also for mutation of names in revenue records. Hence, the request of the petitioner cannot be accepted. However, it is always open to the petitioner to make an appropriate application in the prescribed format before appropriate authority, in which event

the same shall be dealt with in accordance with law, if the petitioner satisfies all the requirements.

Accordingly, the Writ Petition is disposed of. No order as to costs.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
