THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON Nos.29557 OF 2012 and 25519 of 2015 COMMON ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) Sri Nimmagadda Venkateswarlu, learned counsel for the Amudalavalasa Municipality, Srikakulam District, the petitioner in both these cases, and Sri P. Raghavendra Reddy, learned counsel appearing for the unofficial respondents herein, would state that the issue arising for consideration as to the entitlement of the unofficial respondents to annual grade increments stands settled by the decision of this Court in W.P.No.29649 of 2015. A copy of the order dated 06.03.2018 passed in the said writ petition is placed on record.

For reasons alike as were mentioned in the aforestated order and in terms thereof, these writ petitions are disposed of declaring that the unofficial respondents herein are entitled to the benefit of annual grade increments applicable to their time scales only from the date of their filing O.A.Nos.9932 of 2011 and 21 of 2012 before the Andhra Pradesh Administrative Tribunal, Hyderabad. As Sri Nimmagadda Venkateswarlu, learned counsel, would state that the petitioner Municipality would be constrained to approach the State Government for sufficient funds to meet the liability occasioned by the grant of this relief, the petitioner Municipality is granted four months time from today to pay the arrears of the increments. The petitioner Municipality shall however

extend to the unofficial respondents the benefit of the annual grade increments in praesenti.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date: 27.03.2018 ____________________ JUSTI CE M.GANGA RAO va
