HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.31115 of 2015 ORDER:

Heard learned counsel appearing for the petitioner and learned Government Pleader for Women & Child Welfare appearing for respondents 1 to 4.

This writ petition is filed seeking to declare the impugned proceedings dated 14.09.2015 issued by the 1st respondent as arbitrary and illegal and to direct the respondents to reinstate the petitioner into service as Anganwadi Worker of Konidedu.

The petitioner was appointed as Anganwadi Worker vide proceedings dated 17.11.2006 issued by the 2nd respondent. While so, show cause notice dated 12.11.2014 was issued to her for not distributing the Balamrutham to the beneficiaries and not intimating the information about the excess stock. The petitioner submitted her explanation. Again the 1st respondent issued another show cause notice dated 25.11.2014. After lapse of nine months, the 1st respondent vide impugned proceedings dated 14.09.2015 removed the petitioner from service without conducting any enquiry. The Sarpanch of Konidedu Gram Panchayat submitted a representation dated 15.09.2015 to the 3rd respondent to continue the petitioner in service. On 19.09.2015, the petitioner also submitted representation to the 3rd respondentDistrict Collector, Kurnool and the same is pending. Since the representation said to have been submitted by

the petitioner is pending before the 3rd respondent, I am not inclined to go into the merits of the case.

Hence, the Writ Petition is disposed of directing the 3rd respondent to dispose of the representation dated 19.09.2015 submitted by the petitioner and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order. No costs.

As a sequel, Miscellaneous Applications, if any, shall stand closed.
