THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19476 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondents 2 to 4 in threatening to dispossess the members of petitioner society from house sites granted in the year 2001 in Survey Nos.837 and 838, Upparpally, Shameerpet Mandal, Medchal Malkajgiri District, without following due to process of law, as illegal and consequently, to direct the respondents not to dispossess the members from their respective house sites.

At the time when the matter is taken up for hearing, learned Assistant Government Pleader for Revenue appearing for the respondents would submit that the relief sought for in the writ petition cannot be granted as it is an association, which has filed the writ petition alleging dispossession. He further submits that the petitioner has to file writ petition seeking relief of individual members of the society.

The objection taken by the learned Assistant Government Pleader is sustained.

At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to file a fresh writ petition seeking individual relief by setting out the details and necessary supporting documents.

Permission, as sought for, is accorded.

Accordingly, the Writ Petition is dismissed as withdrawn granting liberty as sought for by the petitioner. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
