THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22443 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondents 2 and 3 in producing teak timber of the petitioner, recovered from the possession of thieves, before the competent Criminal Court as illegal and arbitrary.

At the time when the matter is taken up for hearing, the learned AGP, on instructions, submits that the property belonging to the petitioner i.e. teak timber, which is the subject matter of theft in crime No.129/2017, is deposited before the Additional Judicial Magistrate of First Class, Manthini, on 12.07.2017, by the respondent-Police vide CPR No.76 of 2017.

In view of the above, the writ petition is disposed of giving liberty to the petitioner to make an appropriate application before the concerned Criminal Court seeking release of the property. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
