ORDER

This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused Nos.3 and 4 seeking to enlarge them on bail in connection with Crime No.55 of 2026 of RPS Police Station, Hyderabad. The offence alleged against the petitioners is punishable under Section 8 (c) read with 20 (b) (ii) (B) of the NDPS Act of RPS, Hyderabad.

The case of the prosecution is that on 16.04.2026 the complainant lodged a report before police stating that on the same day about 4:20 PM he along with his staff were performing general check at Hyderabad Railway Station, they observed two persons sitting platform No.6 in a suspicious manner with a black colour luggage bag. On enquiry, they disclosed their names as A.3, A.4 and also furnished their details and on opening the said bag they found 09 wrapped bundles with adhesive plaster and they also admitted about the illegal possession of ganja. They seized the contraband weighing about 18.852 kgs of Ganja, registered a case for the aforesaid offence and remanded them to judicial custody on 17.04.2026 and since then they are in jail.

Heard Sri K.Sathish Chakravarthy, learned counsel for the petitioners/Accused Nos.3 and 4 and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondent-State.

The contention of learned counsel for the petitioners is that the petitioners are innocent of the offence alleged against them; that the petitioners are in judicial custody since 16.04.2026; that the contraband

seized from the possession of the petitioners is only an intermediate quantity;

that material part of the investigation is completed, as such they are requested to grant regular bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence alleged against the petitioners is punishable under the provisions of NDPS Act. He further submits that though it is an intermediate quantity, the investigation is not at completed, at this stage, the petitioners are not entitled for bail and hence, he prays this Court to dismiss the petition. However, he submits that no other cases are pending against the petitioners.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, the petitioner has been in judicial custody since 16.04.2026; that seized contraband is an intermediate quantity and L.Ws.1 to 13 were already been examined. Considering the nature of allegations, period of incarceration and also progress in investigation, this Court deems it fit to grant bail to the petitioners/Accused Nos.3 and 4 subject to the following conditions:

(i) The petitioners-accused Nos.3 and 4 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the learned II Additional Sessions Judge, Hyderabad District at Nampally.

(ii) On such release, the petitioners-accused Nos.3 and 4 shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioners-accused Nos.3 and 4 shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 7.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
