HONOURABLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL PETITION No. 13459 OF 2013 O R D E R :

This Criminal Petition is filed under section 482 Cr.P.C., seeking to quash the proceedings in D.V.C.No.424 of 2012 on the file of the Court of IV-Metropolitan Magistrate, Erra Manzil, Hyderabad by the petitioners.

2. Learned counsel for the petitioners not present.

3. Sri Mirza Safiulla Baig, learned counsel for the second respondent submits that D.V.C.No. 424 of 2012 has been allowed granting a sum of Rs.20,000/- [Rs. Twenty Thousand only] per month to the petitioner and her two children towards maintenance, under section 20 of the Act. The trial Court also granted a sum of Rs.3,00,000=00 [Rs. Three lakhs only] towards compensation under section 22 of the Act, directing respondents 1 to 6 to pay the said compensation amount to the petitioner. The first respondent was directed to pay the maintenance of Rs.20,000/- [Rs. Twenty Thousand only] per month to the petitioner on or before 10th of every succeeding month and he shall deposit the amount into the bank account of the petitioner, who in turn

shall furnish her account number to the respondent forthwith. Respondents 1 to 6 shall pay the compensation within three months and the first respondent shall clear the arrears of maintenance amount within three months from the date of the order. The petitioner was also granted the relief of protection order and the respondents were directed not to dispossess the petitioner and her children from the house bearing No. 19-4-279/S/35, Saleheen colony, Hyderabad and they are restrained from entering into the said house.

4. The learned counsel for the second respondent submits that the learned IV-Metropolitan Magistrate, Hyderabad, has passed a judgment and decree dated 28/04/2016 in D.V.C.No. 424 of 2012 and therefore, this criminal petition has become infructuous.

5. In view of the submission of the learned counsel for the second respondent, this Criminal Petition is dismissed as infructuous.

6. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition stands disposed of.
