O R D E R :
This writ petition is filed seeking mandamus to declare the action of the fifth and sixth respondents in failing to register the complaint of the petitioner dated 01/2/2018 sent under registered post with acknowledgement due till date, as illegal, arbitrary and contrary to the provisions of Criminal Procedure Code and consequently to direct the fifth and sixth respondents to register the said complaint and take up investigation against the accused mentioned in the complaint and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.
3. The learned Assistant Government Pleader for Home submitted written instructions filed by the Sub-Inspector of Police, Machavaram Police Station, Guntur Rural district stating that the place of occurrence is Battilu area of Haripriya mill and Pawthatgandeshpaud to Konanki, Battilu areas to Adarsha colony did not fall within the jurisdiction of Machavaram Police Station, therefore, Pidguralla Police on the basis of the complaint of the petitioner, registered a case in Crime No. 195 of 2018 for the offences punishable under section 379, 506 read with section 34 of IPC against the accused.
4. Recording the same, the writ petition is disposed of at the admission stage.
5. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand disposed of. No costs. _____________________________ JUSTICE A. RAJASHEKAR REDDY.
