CVNR, J & GSP, J WP.No.25642 of 2017 Dated:02.8.2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) The grievance of the petitioner, as expressed by many others in similar cases, is that having initiated the departmental proceedings, the respondents have not been either completing the same or considering his case for promotion on the ground of pendency of departmental proceedings.

Despite several orders being passed by this Court finding fault with the respondents for the inertia being shown by them in keeping the departmental proceedings pending for long years and not considering the delinquents for further promotion on the ground of pendency of the said proceedings, the Andhra Pradesh Administrative Tribunal at Hyderabad, has dismissed O.A.No.21617 of 2017 filed by the petitioner, vide order, dated 25.7.2017.

At the hearing, the learned Assistant Government Pleader for Services (Andhra Pradesh) appearing for the respondents has not disputed that several orders were passed by this Court directing the respondents to consider the cases of the officers facing departmental proceedings for promotion along with others and one such order is dated 18.3.2016, in Writ Petition No.8690 of 2016.

In the light of the above, the Writ Petition is disposed of and the respondents are directed to consider the case of the

CVNR, J & GSP, J WP.No.25642 of 2017 Dated:02.8.2017 petitioner for promotion, as and when the Departmental Promotion Committee is constituted, without reference to the charges framed against him, but, however, subjecting such promotion to the outcome of the pending departmental proceedings.

As a sequel to disposal of the Writ Petition, WPMP.No.31802 of 2017 filed by the petitioner for interim relief is disposed of as infructuous.
