HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.39100 of 2015 ORDER :

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.

The grievance of the petitioner in this Writ Petition is that one proclainer and two tippers along with machinery belonging to the petitioner which were hired to 5th respondent were seized by the respondent Nos.2 to 4.

Petitioner contends that 5th respondent is not the owner of the said vehicles or machinery and the respondent Nos.2 to 4 are not entitled to seize the same.

Learned Standing Counsel appearing for respondent Nos.2 to 4 states that if the petitioner produced proof of ownership of the vehicles as well as the machinery, the respondent Nos.2 to 4 will release the same to the petitioner. 5.

Learned counsel for the petitioner states that the petitioner will produce the registration book of the proclainer, tippers as well the relevant documents relating to the machinery seized by the respondent Nos.2 to 4 to prove that the petitioner is the owner thereof.

On production of the said documents after satisfying itself that the petitioner is the owner of the above vehicles and machinery, respondent Nos.2 to 4 shall release the same to the petitioner.

The Writ Petition is disposed of with the above directions. No costs.

8.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
