HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18288 of 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed to declare the inaction of respondent No.2 in forwarding applications of the petitioner, dated 12.02.2014 and 16.09.2015 to respondent No.1 for granting Freedom Fighters Pension under the Swatantrata Sainik Samman Pension Scheme 1980, as arbitrary and illegal and consequently, direct the respondents to grant Freedom Fighters Pension to the petitioner.
2. Petitioner claims to be a Freedom Fighter and prior to 12.02.2014 and 16.09.2015 he made applications for grant of Freedom Fighters Pension. As no action has been taken, the petitioner filed W.P.No.27456 of 2012, which was dismissed with a liberty to the petitioner to make fresh application to respondent No.1 through respondent No.3 therein. In pursuance of the same, the petitioner filed fresh application on 16.09.2015 along with relevant documents through registered post to respondent No.2 with a request to forward the same to the 1st respondent for grant of Freedom Fighters Pension. Even after lapse of two years, the 2nd respondent neither rejected the application nor forwarded the same to the 1st respondent. Hence, the Writ Petition.
3. Heard both sides.
4. In view of above facts and circumstances, respondent No.2 is directed to consider the application of the petitioner, dated 16.09.2015, and take action for forwarding the same to respondent No.1 and thereafter, respondent No.1 shall dispose of the same in accordance with law, as expeditiously as possible.
5. With the above direction, the Writ Petition is disposed of. There
shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
