This writ petition is filed challenging the termination order dated 22-07-2003, wherein petitioner's services were terminated on the ground that elections were over and services of petitioner is no more required.

Learned counsel for the petitioner says that though the petitioner was joined on temporary basis, without issuing notice services of the petitioner cannot be terminated.

Though notice is issued, none appears for the respondent-Pharmacy Council. This Court granted interim order on 28-07-2003 and the same was abated on 23-06-2004. Interim order was also not implemented and the petitioner is out of service since the date of termination itself. A perusal of appointment order goes to show that the petitioner is appointed as Junior Assistant on temporary basis and only worked as such for about 15 months. While terminating the services of the petitioner, no allegations are made. The appointment order was issued in the form of proceedings by the President of Pharmacy Council on 23-04-2002 also goes to show that the petitioner is appointed as Junior Assistant on temporary basis on usual pay and allowances and his services are temporary and he would be terminated at any

time without prior notice. That proceedings are also not challenged by the petitioner and the termination order also goes to show that the petitioner is appointed for specific purpose i.e. till elections. It is stated that the services of the petitioner as Junior Assistant is no more required, as such he was relieved on 31-07-2003. It is also not the case of the petitioner that he was appointed after following due process of selection.

In view of the same, I do not see any merit in the writ petition. However, it is open for the petitioner to make application to the respondent-authorities for consideration of his case and it is open for them to consider the case of the petitioner in accordance with law.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 12-07-2017 Nvl
