HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.3045 of 2015 ORDER:

This revision is filed against the order, dated 1311-2015 passed in Criminal M.P.No.849 of 2015 in M.C. No.12 of 2013 on the file of the Judicial First Class Magistrate, Cheepurupalli, wherein the learned Magistrate directed the petitioner herein to pay the amount as per the petition on or before 23-11-2015. The main grievance of the petitioner herein is that he filed an application to set aside the e x parte order dated 23-01-2015.

During pendency of the said application, the Court below is proceeding with the execution application. Hence, the present revision. Considering the facts and circumstances of the case, the trial Court is directed to proceed in Criminal M.P.No.849 of 2015 after disposal of the application filed by the petitioner to set aside the ex parte order dated 23-01-2015.
