THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Crl.M.P.No.17699 of 2014 in Crl.P.No.16441 of 2014 and Crl.P.No.16441 of 2014 COMMON ORDER:

The de-facto complainant and her counsel Sri V.Brahmaiah Chowdary appeared. Accused and their counsel Sri V.Nitesh appeared.

Heard both sides and perused the petition.

The Cyberabad Police filed charge sheet in FIR No.251 of 2013 against the accused for the offences under Sections 498A, 324 IPC and Sections 3 and 4 of Dowry Prohibition Act. It is submitted by both the parties that at the intervention of elders, parties have settled the matter in respect of offences under Sections 498A and 324 IPC and Sections 3 and 4 of Dowry Prohibition Act in C.C.No.390 of 2014 on the file of XIV Metropolitan Magistrate, L.B.Nagar and entered into a compromise and hence compromise may be recorded and criminal proceedings in C.C.No.390 of 2014 may be quashed in the interest of justice.

Having regard to the above submission and considering the fact that it is a matrimonial matter and parties have amicably settled the disputes among themselves, and no purpose will be served even if the parties are driven to trial and following the decision in Gian Singh v. State of Punjab and another[1] this

criminal miscellaneous petition is allowed and compromise is recorded and consequently, proceedings in C.C.No.390 of 2014 on the file of XIV Metropolitan Magistrate, L.B.Nagar are quashed.

In the result, both the Petitions are accordingly disposed of.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
