THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.19458 OF 2012 O R D E R :

This writ petition is filed for a writ of mandamus directing the respondents to permit the petitioner to participate in the selection process and interview for appointment to the post of XRay Technician under the control of the respondents herein commencing from 31.07.2012 onwards without reference to sponsoring from the employment exchange as in-service candidate.

This Court on 02.07.2012 in W.P.M.P.No.24949 of 2012 granted interim order placing reliance on the law laid down by the Supreme Court in State of Bihar vs. Upendra Narayan Singh and others {(2009) 5 SCC 65)} directing the respondents to allow the petitioner to participate in the selection process and interview for appointment to the post of X-Ray Technician, if he is otherwise eligible, without reference to sponsorship from the Employment Exchange. The respondents are further directed to cause advertisement in the newspapers with regard to the proposed recruitment and call for applications from all eligible candidates. No counter or vacate stay petition is filed seeking to vacate the aforesaid order. As such, the said order is in operation. Since the relief sought for in the main writ petition and interim application are one and the same, the writ petition is disposed in terms of the interim order dated 02.07.2012 in W.P.M.P.No.24949 of 2012. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
