ORDER

Even after 10 months, no counter-affidavit is filed. Hence, this writ petition is disposed of based on the averments made in the affidavit filed in support of the petition, after hearing learned counsel for the petitioner.

Pursuant to the notification issued by the respondents inviting applications for filling up the posts of Village Revenue Officers and Village Revenue Assistants, the petitioner applied to the said posts. The service conditions are regulated by the Andhra Pradesh Village Revenue Assistant Service Rules notified in G.O.Ms.No.1849, Revenue (VO) Department, dated 28.10.2005, as amended by G.O.Ms.No.502 Revenue (VA), dated 4.8.2012. As per the original rules, the candidate residing in the native district alone is eligible to the post. By virtue of amended G.O.Ms.No.502, dated 4.8.2012, the residence restriction was deleted. However, when appointment was not given to the petitioner on the basis of the report submitted by the Tahsildar, Peddapalli-5th respondent to the 4th respondent on the ground that the petitioner is not a native of Peddapalli, the present writ petition is filed.

Learned counsel appearing for the petitioner submits that appointment order was not issued to the petitioner only on the ground that he is not a resident of Peddapalli Village, though the same restriction was deleted in the amended G.O.Ms.No.502, dated 4.8.2012.

This Court is not aware as to whether any other eligible person exists.

In the circumstances, the 6th respondent-District Collector is directed to verify the record and if the petitioner is eligible to be appointed, an appropriate order should be passed in relation to the petitioner, within a period of four weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. ______________________________ JUSTICE A.RAMALINGESWARA RAO 20th November, 2017 rkk
