THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.7918 OF 2015 ORDER:

It is the case of the petitioner that her husband died on 21.08.2014 while working as a driver in the respondent-Corporation. He left behind him the petitioner and three children. The husband of the petitioner was appointed on 01.08.1993 as driver. However, a charge memo was issued for his alleged unauthorized absence from 16.08.2010 to 11.07.2011 and on the basis of the enquiry conducted in respect of the said charge, he was removed from service by proceedings dated 27.12.2011. Against the said order of removal, he preferred an appeal to the appellate authority and the appellate authority ordered his reinstatement into service. In the medical examination, he was declared unfit for the post of driver. He was sent for medical examination to Tarnaka Hospital, Hyderabad on 21.05.

2014 in order to provide alternate job but the husband of the petitioner did not appear on the said date. A show cause notice was issued on 18.08.2014 for his non-appearance before the medical board but before submitting his explanation, he died on 21.08.2014. In those circumstances, the petitioner submitted a representation on 18.12.2014 requesting for release of terminal benefits and also for appointment on compassionate grounds. When the same was not considered, the present Writ Petition is filed. Even after nearly 18 months of giving time, no counter affidavit is filed by the respondent-Corporation.

In the circumstances, this Court is inclined to dispose of the present Writ Petition, without going into the facts of the case, by directing the respondent-Corporation to consider the representation of the petitioner dated 18.12.2014 in accordance with law within a period of three (3) months from the date of receipt of a copy of this order and pass appropriate orders.

The Writ Petition is, accordingly, disposed of. There shall be no

order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
