THE HON'BLE SRI JUSTICE S. RAVI KUMAR CMA No.211 of 2009 JUDGMENT:

This appeal is filed questioning order dated 01-09-2005 in EIC (SR) No.1358/2005 on the file of Employees Insurance Court-cum-Chairman, Industrial Tribunal-1, Hyderabad.

2. Appellant herein filed application under Section 75 (1) (g) of Employees State Insurance Act and the Court below dismissed that application holding that it is barred by limitation. Questioning the same, present appeal is preferred.

3. As many as four adjournments are granted to the appellant from

April 2016 and in spite of that appellant did not evince any interest in prosecuting the case, therefore the appeal is liable to be dismissed for non-prosecution.

4. Accordingly, appeal is dismissed for non-prosecution and as a sequel, miscellaneous petitions, if any, pending in this appeal, shall stand dismissed. No costs.
