HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.39404 of 2015 ORDER:

The petitioner, who is one of the Directors of the Company by name M/s.Cherishma Housing Private Limited, sought mutation in the name of the Company in view of compromise recorded between the Directors and Shareholders in O.S.A.No.25 of 2008, dated 20-08-2010. The application made by the petitioner on 22-04-2015 is stated to be still pending and un-disposed of by the 2nd respondent and aggrieved by the inaction, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue.

In view of the fact that the mutation now sought is in the name of the Company and both the Shareholders and the Directors have compromised the matter, as recorded in O.S.A.No.25 of 2008, referred to above, it is appropriate to direct the 2nd respondent to examine the said application on its own merits and pass appropriate orders thereon, expeditiously preferably within six weeks from the date of receipt of a copy of this order.
