THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T. AMARNATH GOUD WRI T PETI TI ON No.26930 of 2017 ORDER: (per Justice Sanjay Kumar) The petitioner seeks a writ of habeas corpus declaring the inaction of the police authorities in tracing out his children as illegal and to consequently direct them to secure their custody from their mother, the sixth respondent, and to hand them over to him. We interacted with the children in camera and we find that they are both quite happy staying with their mother. They however seem to have had no contact with their father for a year. However, as a writ of habeas corpus is a procedural writ and is not intended to settle custody issues between warring parents, we are of the opinion that it would be appropriate for the parties to approach the proper court to seek suitable relief in accordance with law. Reserving liberty to them to do so, the writ petition is dismissed. No order as to costs.
