HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION NO.14246 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.2 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.82 of 2015 on the file of Dharur Police Station, registered for the offence punishable under Sections 342, 324, 323 r/w 34 IPC and Section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities)Act.

Heard and perused the material available on record. The petitioner is the brother of the husband of the de facto complainant. It is alleged that he along with A1 abused her in the name of her caste.

It is stated that the other accused were arrested and after their remand, they were released on bail.

Considering the facts and circumstances of the case and the nature of the offence alleged, this Court is inclined to pass the following order:

The petitioner-accused No.2 is directed to surrender before the Court concerned and file an application seeking regular bail and on such application being filed, the Court Concerned is directed to consider the same on the same day.
