THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19479 of 2019 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief: "to issue a Writ in the nature of Writ of Mandamus or an appropriate Writ or order or direction to the Respondents holding that the action on the part of the Respondents in "Declining" to sanction exgratia relief, through Govt.

Memo No 524/DM-I/A1/2019 Dt. 31.05.2019 to the Petitioner herein for the death of her husband on 01.10.2016 due to "Thunderbolt", despite of the finality of the orders of this Hon'ble High Court of Judicature, Hyderabad issued in WP/1799/2019, dated 06.02.2019 holding that G.O.Ms.No.1, Revenue (DM-I) Department, dated 04.05.2015 squarely covered under SDRF Rules notified by the Government of India and the victim's family would be entitled to ex-gratia as per the said G.OMs.No.1, Revenue (DM-I) Department, dated 04.05.2015, as illegal, arbitrary and violation of fundamental rights guaranteed under the Constitution and the same may be set aside. Consequently to direct the Respondents to pay exgratia of Rs. 5,00,000/ (Rupees Five lakhs only) to the Petitioner herein, within a time bound period."

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents.

Leaned counsel for the petitioner would submit that the issue involved in this Writ Petition is squarely covered by the order of this Court, dated 06.02.2019, in W.P.No.1799 of 2019. The

same is not disputed by learned Assistant Government Pleader for Revenue appearing for the respondents.

Following the said order and for the reasons stated therein, this Writ Petition is also disposed in terms of the said order directing the District Collector, District Collectorate, Kamareddy, Kamareddy District, the 2nd respondent herein, to take appropriate action on the petitioner's representation, dated 21.05.2019, in terms of G.O.Ms.No.1, Revenue (DM-I) Department, dated 04.05.2015, and release the amount due to the petitioner expeditiously and in any event, not later than four (4) weeks from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ____________________________ CHALLA KODANDA RAM, J SEPTEMBER 11, 2019 Note:
