Heard the learned counsel for the petitioner and the Government Pleader for Irrigation and perused the prayer of the writ petition, proceedings dated 19.10.2009 and the interim order granted by this Court on 23.12.2009.

Having regard to the facts and circumstances, this Court is of the view that the cause in the writ petition does not survive for adjudication.

Accordingly, the Writ Petition is dismissed as infructuous. No costs.
