HON'BLE SRI JUSTICE S.V. BHATT W.P. No.19455 OF 2013 ORDER:

Heard counsel for petitioner and the Assistant Government Pleader for respondents 1 to 4.

The petitioner complains against inaction of respondents 3 and 4 in registering the complaint dated 18.06.2013 and proceeding to investigate the matter, as illegal, arbitrary and unconstitutional.

The Sub Inspector of Police, Dammugudem P.S. filed counter affidavit.

It is a matter of record that the annexures filed along with the writ affidavit do not evidence receipt of complaint by the Police. Be that as it may, there seems to be a civil dispute between petitioner and respondent No.5. As there is civil dispute, the parties have to work out remedies before the Court having jurisdiction and, if an offence either cognizable or non-cognizable is made, the petitioner is given liberty to send the complaint by registered post with acknowledgement due to respondent No.4.

With the above observation, the writ petition is dismissed. No order as to costs.
