HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.17286 OF 2018 ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioner has challenged the order dated 28.03.2013 passed in O.A.No.7430 of 2011 whereby the petition filed under Section 19 of Administrative Tribunals Act 1985 by respondent No.1 has been allowed while setting aside promotion order of the petitioner.

2. There is an in ordinance delay of 5 years in filing the present petition which hit by delay and latches and not explained properly. Therefore, we are not inclined to interfere with the order passed by the Tribunal.

3. At this stage, learned counsel appearing on behalf of the petitioner submits that after giving affect to the order dated 28.03.2013 passed by the Tribunal, several Junior officers of the said department were promoted however the case of the petitioner was not considered. To this effect, the petitioner seeks liberty to file representation to the concerned department.

4. In view of above, liberty is granted to petitioner to file representation to the concerned department. On receipt of the representation from the petitioner, the respondents are

directed to dispose of the same within two (02) months from the date of receipt of the representation.

5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any pending, shall stand closed.
