THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19484 of 2019 O R D E R :

This writ petition is filed challenging the action of the respondent No.4 in preventing the petitioner from making the construction in his land admeasuring 377.77 Sq.Yards in Sy.No.310/C/1, situated at Kesamudram Village, Mahabubabad Mandal and District, at the behest of 5th respondent and thereby causing interference in the civil disputes of the petitioner. Learned Assistant Government Pleader for Home produced written instructions dt.07.09.2019 submitted by the Asst.Sub-Inspector of Police, Kesamudram P.S., Mahabubabad District.

To the extent of their relevance to the present writ petition, the said instructions read as under.

"It is submitted that the allegations made by the petitioner that the respondent No.4 is making calls and sending the police constables to his site and prevented the labours to stop construction work is false and denied herewith, as the police personnel never went to his site nor prevented any labours from doing construction work. It is submitted that in fact two cases are registered against the petitioner J.Devender in Keesamudram police station.

(1) Crime No.79/2019, U/s.447 IPC of Kesamudram Police Station 2.7.2019, wherein he is shown as Accused No.1 in the said case. The said case is under investigation.

(2) Crime No.93/2019, U/s.107 Cr.P.C. of Kesamudram Police Station on 30.07.2019.

It is submitted that in order to divert the attention of the investigating officer, the petitioner had come up with present writ petition to bring pressure on the police officials, all the averments and contention raised in the writ affidavit are false are denied."

Learned counsel for the petitioner states that the writ petition can be disposed of recording the aforesaid written instructions of the respondent police.

In view of the above, the writ petition is disposed of recording the aforesaid written instructions of the learned Assistant Government Pleader. Further, the respondent police are directed not to interfere with the construction activity of the petitioner. However, this order will not preclude the respondent authorities from investigating into the aforesaid crimes. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
