THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3497 OF 2016 ORDER:
This petition is filed by the petitioner-complainant under Section 482 Cr.P.C. seeking a direction to the Court of the XIII Additional chief Metropolitan Magistrate, Nampally, Hyderabad, to dispose of CC No.216 of 2013 on its file as early as possible preferably within a period of two months.
Heard and perused the material available on record. It is the case of the petitioner that her marriage was performed with the 2nd respondent on 12.10.2011 and it was stated that at that time, the 2nd respondent is working in HCL Technologies, Chennai. Subsequently, she came to know that the educational certificates of the 2nd respondent are fraud. Thereafter, the 2nd respondent and his family members have started harassing the petitioner to bring additional dowry. Therefore, she lodged a complaint against the 2nd respondent and his family members for the offence punishable under Section 406 IPC. After completion of investigation, charge sheet was filed against respondents 2 and 3 and the same was numbered as CC No.216 of 2013.
The grievance of the petitioner is that the case is pending for a long time and she attending the Court regularly and the case is now coming up for her evidence. Even though the case is pending from the year 2013, there is no progress in the case. Due to the pendency of the case, the petitioner lost her opportunity to go to USA and now she got another opportunity to go to USA on project work and hence, the petitioner requests to direct the Court below to dispose of the case as expeditiously as possible.
The XIII Chief Metropolitan Magistrate, Nampally, Hyderabad, is directed to dispose of CC No.216 of 2013 as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order.
With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
