Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The present Criminal Petition came to be filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973, by the petitioner/Accused seeking enlargement on bail in connection with Crime No.95 of 2016 of Reinbazar Police Station, Hyderabad City, registered for the offences punishable under Sections 370 and 420 IPC.

The case of the prosecution is that the informant contacted the petitioner to send her daughter by name Asima Khatoon to K.S.A., as a maid, due to poverty, for which she agreed to pay a sum of Rs.20,000/-. After arranging Visa, the daughter of the informant was sent to Riyadh in the month of December, 2015 to work under one Abdul Rahman Ali Mohammed. Since the date of joining, the said person was harassing the daughter of the informant physically and mentally and unable to bear the torture, her daughter requested the said person to send her back, but there was no proper response. The alleged acts of the said person came to be known to the informant when her daughter secretly telephoned to her. As things came thus, the informant repeatedly demanded the petitioner to see that her daughter is sent back. However, the petitioner is alleged to have demanded an amount of Rs.2,00,000/- for sending her daughter back to India. Since the final contact with her daughter was on 01.03.2016, the informant apprehends the survival of her daughter.

Basing on these

allegations the present crime came to be registered.

4. Learned counsel for the petitioner submits that the petitioner is innocent of the offences alleged against her and she was falsely implicated in this case. It is urged that since investigation is over, the petitioner may be released.

5. Learned Public Prosecutor submits that the information received by the police is to the effect that the daughter of the informant died in Riyadh. The said information was not even forwarded to the informant. Be that as it may, material placed on record would show that earlier the petitioner approached this Court for grant of bail by filing Criminal Petition No.9030 of 2016 and the same was dismissed on 13.06.2016. There is no change in the circumstances of the case till date.

6. Having regard to the circumstances stated above, nature of offences alleged against the petitioner and in the absence of any change in the circumstances, I am not inclined to grant bail to the petitioner.
