HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7443 OF 2017 ORDER:
This writ petition is filed declaring the endorsement dated 01.02.2017 vide L.Dis.H/4/2017 of the 3rd respondent in respect of the land to an extent of Ac.0.31 cts in S.No.180/10 of Jeepalem Village, Renigunta Mandal, Chittoor District, as illegal and arbitrary.
Learned counsel for the petitioner submits that without issuing notice to the petitioner, the respondent authorities passed orders dismissing the appeal, that too going into title aspects, which they are not empowered to do.
Heard the learned Assistant Government Pleader for Revenue.
A perusal of the impugned order goes to show that the appeal filed by the petitioner was dismissed without issuing notice to the petitioner as well as unofficial respondents. In view of the same, this Court feels that the writ petition can be disposed of by setting aside the impugned endorsement dated 01.02.2017, as no notice was issued to the petitioner as well as the unofficial respondents before passing it. Only on the ground of violation of principles of natural justice, the impugned order dated 01.02.2017 is set aside and the 3rd respondent is directed to dispose of the appeal filed by the petitioner after issuing notice to the petitioner as well as unofficial respondents.
With the above direction, the writ petition is allowed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 03.03.2017 dv
