This Writ Petition is filed for a Mandamus to declare the inaction of respondent No.3, in attesting the front page of title deed in respect of Acs.2-00 cents of land in Survey No.831-B of Sarveypalli BitVillage Fields, Venkatachalam Mandal, SPSR.Nellore District, with date and office seal, as illegal and arbitrary.
At the hearing, the learned Assistant Government Pleader for Revenue (AP), on instructions, submitted that as the documents submitted by the petitioner suffer from certain defects, respondent No.3 has not attested the title deed by putting the date and office seal.
In my opinion, respondent No.3 cannot sit over the file on the ground of purported defects for more than three years. If he finds any legal defects, he shall pass appropriate order pointing out such defects and communicate the same to the petitioner. As respondent No.3 has failed to do so, he is directed to forthwith make an endorsement and communicate the same to the petitioner. If the petitioner feels aggrieved by such endorsement, he shall be free to avail appropriate remedy.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, WPMP.No.24785 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 6th July, 2015 LUR
