HON'BLE DR JUSTICE SHAMEEM AKTHER Crl.P. No. 6281 of 2017 O R D E R:- Heard Sri N. Naveen Kumar, learned counsel for the petitioner - Accused No.1 and the learned Additional Public Prosecutor appearing on behalf of the 1st respondent - State and perused the material on record.

The learned counsel for the petitioner has submitted that this Criminal Petition is filed to quash the order dated 16.04.2015 made in Crl.M.P.No. 412 of 2015 in C.C.No. 848 of 2011 on the file of the Court of X Metropolitan Magistrate, Cyberabad at Malkajgiri on the ground that this Court, by order dated 30.09.2011 in Crl.P.No. 9437 of 2011, while disposing of the petition, dispensed with the personal appearance of the petitioner - A1 before the trial Court. It is also submitted that the petitioner is ready to file an application before the trial Court to recall his warrant by making his personal appearance. It is also brought to the notice of this Court that the petitioner is staying in Dubai. In view of the submissions made by the learned counsel for the petitioner, the Non-Bailable Warrant issued against the petitioner in Crl.M.P.No. 2223 of 2014 shall be recalled on condition that the petitioner - A1 appears and files an appropriate application before the trial Court within a month

Dr.SA,J Crl.P_6281_2017 from the date of this order. The police shall not execute the Non-Bailable Warrant till the expiry of the aforesaid period. Accordingly, the Criminal Petition is ordered. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
