THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2321 of 2016 ORDER:
This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.1 seeking to quash order, 24.10.2014, in CC No.107 of 2006, for the offences punishable under Sections 323, 341, 407 and 420 r/w.34 IPC, passed by the Judicial Magistrate of First Class, Prathipadu, wherein the learned Magistrate issued N.B.W. against petitioner-accused No.1. The learned counsel for the petitioner submitted before this Court that the petitioner is ready to face the trial and he will not flee from the hands of justice.
Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that the criminal petition can be disposed of with the following directions: The petitioner-accused No.1 is directed to appear before the Court concerned and file a petition to recall the warrant issued against him and on filing of such petition, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum and further the petitioner is directed to appear before the trial Court regularly.
Accordingly, the criminal petition is disposed of. Miscellaneous petitions pending in this criminal petition, if any, shall stand closed. ______________ RAJA ELANGO, J February 24, 2016.
