HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27801 of 2017 ORDER:
In the Writ Petition, though cancellation of contract by the impugned letter dated 02.06.2017, is challenged, learned Counsel for the petitioner submits that, on account of various difficulties, petitioner could not execute the contract, and made a representation dated 09.06.2017 setting out details for non-execution, and therefore, seeks indulgence of this Court to direct the respondents to consider the same sympathetically.
Learned Assistant Solicitor General appearing for respondents submits that it is a contractual matter, and ample time was granted to the petitioner to execute the work which they had failed to do, and the project being of importance, cancellation order cannot be interfered with. Considering the submissions made by the learned Counsel and, without expressing any opinion on the merits of the case, the Writ Petition is disposed of with a direction to the respondents to consider the representation of the petitioner dated 09.06.2017 within a period of four weeks from the date of receipt of a copy of this order, and communicate decision to the petitioner.
Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
