THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Crl.P.MP.No.10520 OF 2015 IN/AND CRIMINAL PETITION No.10526 of 2015 ORDER:

The criminal petition is filed under Section 482 of the Code of Criminal Procedure, 1973 seeking to quash the proceedings in C.C.No.882 of 2013 on the file of the I Additional Judicial First Class Magistrate, at Nizamabad, which is out come of the Crime No.7 of 2013 of Nizamabad Women Police Station on the complaint of the first respondent against the petitioners, registered for the offences punishable under section 498-A of the Indian Penal Code, 1860 and Sections 4 and 6 of the Dowry Prohibition Act, 1961.

The first respondent/de facto complainant and her counsel are present. The petitioners/A1 to A5 and their counsel are also present. Heard both sides and perused the record.

On the report of the first respondent/de facto complainant, the Station House Officer, Women Police Station, Nizamabad District, registered a case in Cr.No.7 of 2013 against the petitioners/A1 to A5 for the offences alleged, and after completion of investigation, filed the charge sheet.

It is submitted by both parties that at the intervention of the elders, the parties have amicably settled their disputes concerning to present case and hence compromise may be recorded and criminal proceedings in the above case may be quashed.

Having regard to the above submission and considering the fact that the parties have amicably settled the disputes among themselves out of Court and no useful purpose will be served even if the parties are driven to the trial as they compromised, and following the expression of the Apex Court reported in Gian Singh v. State of Punjab and another, the criminal miscellaneous petition is

allowed and compromise is recorded, and consequently, proceedings in C.C.No.882 of 2013 on the file of the I Additional Judicial Magistrate of First Class, Nizamabad, against the petitioners/A1 to A5 are hereby quashed. The Crl.P.MP.No.10520 of 2015 and the Crl.P. No.10526 of 2015 are accordingly allowed.

Pending miscellaneous applications, if any, shall stand closed in consequence.
