This Writ Petition is filed seeking writ of mandamus declaring the condition No.1 under additional conditions of letter dated 22.01.2019 on the application No.014002/11/U6/HMDA/24072018, dated 24.07.2018 issued by the 2nd respondent insisting the petitioner to handover the road effected area under the proposed master plan to the local authority at free of cost as illegal and arbitrary and for consequential directions.
Heard learned counsel for the petitioner and Sri V.Narasimha Goud, learned Standing Counsel for the respondents.
Sri V.Narasimha Goud, learned Standing Counsel submits that while issuing permission to the owner to convert the subject property from residential to manufacturing zone, certain conditions were imposed by issuing G.O.Ms.No.2, Municipal Administration & Urban Development (Plg.I(1) Department, dated 03.01.2019 and the petitioner being tenant of the landlord is bound by the same. He submits that but for the aforesaid GO issued for the change of land use from residential use to manufacturing zone, the application of the petitioner for establishing fly ash bricks company, could not have been entertained.
Learned counsel for the petitioner submits that liberty may be granted to the petitioner to challenge the G.O.Ms.No.2, Municipal Administration & Urban Development (Plg.I(1) Department, dated 03.01.2019.
Recording the submission of the learned counsel for the petitioner, this Writ Petition is disposed of granting liberty to the petitioner to challenge the GO Ms.No.2, dated 03.01.2019, in accordance with law.
