THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.19505 of 2019 ORDER:

This Writ Petition is filed challenging the impugned order in proceedings No.HN/A2/Arms/6903/2018-19, dated 20.08.2019, wherein and whereby the application of the petitioner for renewal of his Arms Licence beyond 31.12.2018 was rejected on the ground he does not have any specific threat to his life and there is no genuine reason to continue his Arms Licence.

Heard learned counsel for the petitioner and learned Government Pleader for Home.

Learned counsel for the petitioner submits that though the Deputy Commissioner issued show cause notice dated 31.01.2019 calling for explanation of the petitioner as to why arms licence should not be cancelled, the Commissioner passed the impugned order dated 20.08.2019 without assigning any reasons. 4.

This Court considered the similar issue in W.P.No.2673 of 2019 and by its order dated 11.06.2019 set aside the rejection order which was passed only on the ground that the applicant does not have specific threat and directed to the respondents therein to reconsider the issue in terms of the provisions of the Arms Act. 5.

In view of the same and following the order dated 11.06.2019 in W.P.No.2673 of 2019, the impugned order is set aside. The 2nd respondent is directed to reconsider the application of the petitioner for renewal of Arms Licence.

The Writ Petition is accordingly allowed. There shall be no order as to costs. Miscellaneous petitions, if any, filed in this Writ Petition shall stand closed.
