HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.20986 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the second respondent in acting upon the report submitted by the fourth respondent vide Rc.No.A/207/2011 dated 30.06.2015, against the sixth respondent and also the inaction of the second respondent in disposing of the representation of the petitioner dated 02.01.2016 as being illegal and arbitrary and consequently direct the second respondent to forthwith act upon the said report. In spite of service of notice, respondents 5 and 6 did not choose to appear either personally or through a counsel. Heard the learned counsel for the petitioner and the learned Government Pleader for Endowments, appearing for respondents 1 to 4.

The contention of the learned counsel for the petitioner is that the founder trustee committed some illegalities in the administration of the temple. A perusal of the record reveals that some third parties filed O.A.No.917 of 2015 on the file of the Endowments Tribunal, Hyderabad, challenging the appointment of the sixth respondent as a founder trustee.

In view of the pendency of O.A.No.917 of 2015, this Court is not inclined to express any opinion touching the merits of the main case. A perusal of the record reveals that the petitioner herein submitted a representation to the second respondent on 02.01.2016 and the same is pending before him. The only request of the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 02.01.2016.

Having regard to the facts and circumstances of the case, the second respondent is hereby directed to dispose of the representation of the petitioner dated 02.01.2016 within a period of four weeks from the date of receipt of copy of this order. With the above direction, the writ petition is disposed of. As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
