THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON No.12363 of 2017 ORDER: (Per Justice Sanjay Kumar) The petitioners are the applicants in O.A.No.21/231/2017 on the file of the Central Administrative Tribunal, Hyderabad Bench. They are before this Court aggrieved by the denial of interim relief by the Tribunal vide order dated 04.04.2017.

Perusal of the said order indicates that the Tribunal denied interim relief to the petitioners on the short ground that their allocation order was passed way back in October, 2016, and they were relieved pursuant thereto on 15.02.2017 itself. The Tribunal further observed that as the petitioners had been relieved more than a month prior to the order, it was not inclined to grant any interim relief.

Though Sri M.Venkanna, learned counsel for the petitioners, would assert that the options exercised by the petitioners are binding, he is unable to place before us any material to support his contention. The documents relied upon by the learned counsel in this regard demonstrate that the authorities retained the discretion to pass orders notwithstanding the options exercised by the employees.

That being so, the petitioners would have to await adjudication of the issues raised by them in the O.A. and at this stage, no cause is made out to interfere with the order passed by the Tribunal denying them interim relief.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
