HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.19521 OF 2019 ORDER:

This Writ Petition is filed questioning the inaction of the 4th respondent in not registering the crime basing on the complaint dated 06.06.2019 given by the petitioner herein. Learned Assistant Government Pleader for Home, on written instructions dated 18.10.2019, would submit that the petitioner lodged a complaint on 01.05.2019 with the 4th respondent stating that her in-laws and others have beat and threatended her and her husband on 01.05.2019. Again, the petitioner sent a complaint dated 06.06.2019 through Registered Post, the contents of which are same as the contents of the complaint made on 01.05.2019. Learned Assistant Government Pleader for Home would further submit that based on the complaint made on 01.05.

2019, the offences are non-cognizable in nature, permission has been sought from XXI Metropolitan Magistrate, Medchal on 16.10.2019 and a case was registered as Crime No.751 of 2019 dated 16.10.2019 for offences under Sections 323, 506 IPC against the petitioner's father-in-law and others. However, the learned counsel for the petitioner disputes the provisions under which the accused therein have been charged by the police authorities. Without expressing any opinion, it is open for the petitioner to avail the remedy available under the Code of Criminal Procedure before the appropriate authority in appropriate proceedings.

Granting liberty as sought, the Writ Petition is closed. No costs.

Miscellaneous Petitions, if any pending, in the writ petition shall stand closed.
