HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 26966 of 2015 ORAL ORDER:

This writ petition is filed questioning the action of the third respondent in not considering the representation of the petitioner and other farmers dated 20.6.2015 for conducting pubic auction for the leasehold rights of land belonging to third respondent temple admeasuring Ac. 56.20 cts in Survey No. 185 of Z.Uppalapadu village, Veletivaripalem mandal, Prakasam district as illegal.

2. Heard the learned counsel for petitioner, learned Government Pleader for Endowments (A) and learned standing counsel for third respondent temple and with their consent the writ petition is taken up for disposal at the stage of admission.

3. Land to an extent of Ac. 56.20 cts in Survey No. 185 of Z.Uppalapadu village, Veletivaripalem mandal, Prakasam belongs to third respondent temple was leased out in auction conducted on 29.2.2013 to one Sri Somineni Narasimham for an amount of Rs.60,000/- for a period of one year. The grievance of the petitioner is that though the lease period expired and the present market value of the lease is between Rs.6,000/- to Rs.8,000/- per acre third respondent temple is loosing revenue since no fresh auction is conducted.

Petitioner and other farmers made representation dated 20.6.2015 complaining that the highest bidder Sri Somineni Narasimham is paying the meager amount of Rs.1,000/- per acre and has sublet the property for Rs.5,000/- per acre and requested to conduct auction for the benefit of the temple. Since, no action is taken thereon, the present writ petition is filed.

4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to third respondent to expeditiously dispose of the representation of the petitioner dated 20.6.2015.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the third respondent to consider the representation of petitioner dated 20.6.2015 and pass appropriate orders as warranted under law within a period of four weeks

from the date of receipt of copy of this order and communicate the decision to the petitioner.

No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
