THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1107 OF 2014 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in P.R.C.No.20 of 2013 on the file of the II Additional Judicial Magistrate of First Class, Bhimavaram, arising out of offences under Sections 420, 354, 323 read with Section 34 IPC.
Heard and perused the material available on record. Learned counsel for the petitioner submits that even though the police filed charge sheet by deleting the name of the petitioner herein, the Court below intends to proceed with the case against the petitioner herein.
On perusing the material, this Court is of the view that the learned counsel for the petitioner could not able to show any document showing that the Court below is proceeding with the case against the petitioner herein. Hence, the criminal petition is not maintainable and is liable to be dismissed.
The criminal petition is accordingly dismissed. The petitioner is at liberty to challenge the order, if any, passed by the Court below in proceeding with the case against the petitioner herein.
