HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.12321 OF 2009 ORDER:

The writ petition is filed questioning the action of the respondents in not treating the petitioners as departmental employees and not extending the time scale of pay and other service benefits. When the matter is taken up for hearing, learned counsel for both the parties submitted that the relief claimed in the present writ petition is similar to the relief claimed before the National Industrial Tribunal, Mumbai under Reference No.NTB-1 of 2003 between Food Corporation of India and Their Workmen. As a matter of fact, an interim order dated 27.05.2004 was passed in the said Reference and the same has been challenged before the single Judge and Division Bench of High Court of Mumbai and the same was disposed of vide LPA No.24/2005 on the ground that the similar matter is pending before the National Industrial Tribunal, Mumbai. In that view of the matter, the writ petition may be closed giving liberty to the petitioners to espouse their cause and seek appropriate relief after disposal of the matter by the National Industrial Tribunal, Mumbai.

Accordingly, the writ petition is closed giving liberty to the petitioners to espouse their cause and seek appropriate relief before the appropriate Forum, if they are aggrieved after disposal of the matter in Reference NTB-1 of 2003 by the National Industrial Tribunal, Mumbai. No order as to costs.

Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
